.com.gu FAQ

What name can I register?

Please do not apply for a domain if your goal is to protect your company's tradename and trademark. The correct venue for protecting your trademark is by registering with the Revenue and Taxation.

The trademark holder registered on Guam or USA is the official administrator of the domain name. Tradename and trademarks are enforced by Guam Customs.

TRADENAME
As of July 1995, we have realized a trademark responsibility we cannot avoid. Because of the case of Kaplan vs. Princeton Review, companies should have the right to use their own trade name when requesting a Domain Name. If someone is not using a trade name they are entitled to, the affected party can pursue legal avenues to remedy the situation.

The owner of the TRADENAME cpr144449003101 is the subscriber of the domain.

"A trademark is a word, phrase, symbol or design, or a combination of words, phrases, symbols or designs, which identifies and distinguishes the source of the goods and services of one party from those of others. Anyone who claims rights in a mark may use the TM (trademark) or SM (service mark) designated with the mark to alert the public to the claim. The registration symbol, (R) may only be used when the mark is registered in the PTO." Quoted from the U.S. government trademark pamphlet 'Basic Facts about registering a trademark'.

CHAMORU NAMES
If your Domain uses a Chamoru-Guamanian name, public Law 10-138, 17-10 requires that we will consult with the Guam Place Name Commission regarding the appropriateness of your chamorro domain name. A chamorro word cannot be owned. We will check if objections areraised by the appropriate agencies.
